Fitzroy Sport Massage is a registered business name of Victor Alexander Pty Ltd (ABN 52 696 887 242). In this policy, "we", "us" and "our" mean Fitzroy Sport Massage.
This policy explains how we collect, hold, use, disclose and protect your personal information, including health information, in the course of providing massage services.
Because we provide a health service and hold health information, we are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles, regardless of our size. We are also bound by the Health Records Act 2001 (Vic) and its Health Privacy Principles, which apply to health information in Victoria. We are committed to handling your information in accordance with both.
1. The information we collect
To provide safe and appropriate massage, we collect:
• Contact details, such as your name, phone number and email address
• Health information you provide at intake and during sessions, such as relevant medical history, injuries, areas of pain or tension, conditions, medications where relevant, and the reason for your visit
• Records of the sessions we provide to you, including session notes
• Booking and payment information
Health information is a type of sensitive information and is given a higher level of protection under the law.
2. How we collect your information
We collect information directly from you: through our intake form, in conversation before and during a session, through our online booking system, and through any messages you send us. We collect health information with your consent and only what is reasonably necessary to provide your massage safely.
We do not collect your information from third parties, and we do not buy or rent personal information.
3. Why we collect, hold, use and disclose your information
We use your information only to:
• Assess whether massage is safe and appropriate for you, including identifying anything that should change or rule out treatment
• Provide your sessions and maintain continuity of care between visits
• Manage your bookings, payments and our correspondence with you
• Meet our legal, insurance and record-keeping obligations
We do not use your information for marketing without your consent.
4. Who we disclose your information to
We keep your information confidential. We will only disclose it:
• With your consent
• Where we are required or authorised to do so by law
• To our professional advisers or insurer, where reasonably necessary, for example if a claim or complaint arises
• To the third-party providers described below, who help us operate the practice
We do not disclose your health information to any other person without your consent.
5. Third-party providers and overseas storage
We use trusted third-party services to run the practice, including our website and online booking provider (Squarespace and Acuity Scheduling) and our payment providers. Some of these providers store data on servers located outside Australia, including in the United States. Where this happens, we take reasonable steps to ensure your information is handled consistently with Australian privacy law. We do not otherwise disclose your information overseas.
6. How we store and protect your information
We hold your information securely. Digital records are kept in password-protected, access-controlled systems, and any physical records are kept securely. Access is limited to the practitioner. We take reasonable steps to protect your information from misuse, loss, and unauthorised access, modification or disclosure.
7. How long we keep your information
We are required to retain health information for a minimum period under the Health Records Act 2001 (Vic). For an adult, we keep your health records for at least seven years from the date of your last session. For a person under 18, we keep their records until they turn 25. After that, we securely destroy or de-identify the information when it is no longer needed.
8. Accessing and correcting your information
You have the right to ask for access to the personal and health information we hold about you, and to ask us to correct it if it is inaccurate, out of date or incomplete. Contact us using the details below. We will respond within a reasonable time, generally within 30 days. In limited circumstances allowed by law we may decline access, and if so we will explain why in writing.

If you have a concern about how we have handled your information, please contact us first using the details below. We will acknowledge your complaint promptly and aim to resolve it within 30 days.
